1. Definitions
1.1 The 'seller' means JUST TRAVERTINE.
1.2 The 'buyer' means any person, company, or firm that goods are sold to by the seller.
1.3 The 'goods' means any product sold to the buyer by the seller.
2. Basis of sale.
2.1 On receipt of an order the seller will supply the buyer with an order confirmation; it is the buyer's responsibility to ensure all information in the confirmation is correct as per the order.
2.2 The seller can give general guidance relating to quantities but accepts no responsibility for surplus or shortfall in quantities; it is the buyer's sole responsibility to ensure that the correct quantities are ordered.
2.3 It is the buyer's sole responsibility to ensure the goods are suitable for there intended use.
2.4 The seller recommends that the buyer uses a suitably qualified person to fix the goods.
2.5 All natural stone is susceptible to tonal, colour, and geological variation, for this reason any samples despatched or pictures displayed by the seller cannot be taken as an exact likeness to current batches.
2.6 All special orders must be paid in full at time of ordering and cannot be retracted.
3. Price and Payment.
3.1 All prices are exclusive of V.A.T. (at the current rate) and delivery.
3.2 All goods must be paid for in full and all funds must have cleared before any goods leave the sellers premises.
4. Delivery
4.1 All dates quoted by the seller are approximate only and the seller accepts no liability for any delays in delivery however it may have been caused. Time and date shall not be the essence of the contract unless agreed in writing by the seller.
4.2 Where a delivery a delayed due to circumstances outside of the sellers control the buyer cannot cancel or refuse delivery.
4.3 The buyer must inform the seller at the time of ordering of any access restrictions or difficulties for a large goods vehicle. The seller has no responsibility for a failed delivery due to undisclosed facts or restrictions relating to vehicle access and the buyer shall be liable for the cost of re-delivery.
4.4 The haulier will deliver the goods to the nearest kerb side or to the nearest safe point at the discretion of the driver.
4.5 The buyer has a responsibility to ensure that there is a suitable person present at the time of delivery to inspect and to sign for the goods. Once signed for the goods are the responsibility of the buyer.
5. Damages
5.1 Any obvious damages must be noted on the delivery note at the time of delivery.
5.2 All damages, discrepancies or grievances must be reported to the seller within 24 hours of delivery and in writing within 3 days.
5.3 It shall be deemed that the buyer has accepted the goods in full if there has been no notification of any damages, discrepancies or grievance within 24 hours of delivery.
5.4 No claim can be accepted once the goods have been fixed/fitted or an attempt has been made to fix or fit the goods to wall/floor either in part or full.
6. Cancellation and Returns
6.1 The buyer has the statutory right to cancel their order and return the goods within 7 days of delivery. The goods must be returned to the seller within 14 days and in the same condition and packaging in which they were first received. The goods shall remain the sole responsibility of the buyer until they are received at the seller's premises, also the buyer shall be responsible for the full cost of returning the goods and any damages or losses suffered by the seller.
7. Other Information.
7.1 All natural stones are porous and require sealing or impregnating with an appropriate material.
7.2 The seller accepts no liability for natural flaws, variations in colour, tone, appearance, finish or size of the goods delivered.
7.3 The seller accepts no liability for changes in the goods appearance due to fixing, sealing, or wear and tear.
